Today’s Lesson: Don’t take naked pictures of yourself if you are under 18
In Florida, two teens were found guilty of child pornography laws by taking risque photos of themselves. Here is the background: On March 25, 2004, Two teens (16 and 17) took digital photos of themselves naked in some kind of sex act. The two sent the photos from the girlfriends computer to the boyfriends via email, and neither teen showed the photographs to anyone else.
However the couple was charged with “producing, directing or promoting a photograph featuring the sexual conduct of a child”, with the girlfriend found guilty of child pornography charges.
Kinda makes you wonder about the laws in this country, the laws designed to protect children were used against them. If you are under the age of 18, delete those nude photos now!

I can’t believe that no one sat back and realized this was moronic. Though with that in mind, I better go back through the shoeboxes in the closets and make sure I didn`t keep any photos of girlfriends back in high school… With camera phones, I can`t see how every teen isn`t guilty of this now a days.

Well, see here is my issue with this. Camera phones and teenagers are BOUND to yield naughty pictures, and anyone who says differently is living with their head in the ground. Now, those tow kids created the content for private use within their age bracket. It is a lapse of judgement at worst! For them to get charged with child porn charges is OUTLANDISH!
I am NOT condoning underage pornography (Matter of fact I wish nothing but harm to child pornographers), but this was not designed or created to be such. Doesn’t intent figure into the judgement here?
Just another fine example of people applying a specific law under totally outlandish conditions. People need to realize that we need to enforce the spirit of the law.
Yeah I have to agree with Dan. I don’t condone child pornography what so ever.
But two teens messing around with a digital camera and keeping it between themselves? Not the best idea but definitely doesn’t constitute child porn charges.
What would happen if you were under 18 and took naked pics of only yourself for only yourself (as weird as that sounds)? Could they punish you for that?

What is interesting is, if someone sends me kiddy porn, and it ends up in my junk mail folder or hidden somewhere on my computer, can I be charged of “possession of child pornography”? Of course, if I were in Florida? (What are people from Florida called? Floridians?)
Having RTFA, they seem to have applied a lot of “what if’s” to condemn the teen.
So, if it got out on the ‘net & sold to a terrorist organization, I guess she’s a terrorist and enemy combatant too! Put her in Guantanamo!

What get me is that they didn’t say how the pictures came to end up in the hand of the authority’s in the first place. Was it a case were the parents were nose and was in to there kids mail. (witch should have been passworded any way).
Or was it a case of the ISP and NSA crape that has been being pulled the last few years that basic say we at the NSA and So have the right to stick or nose in any of you privacy any time we like.

Judge Philip Padovano dissented. He wrote that the law “was designed to protect children from abuse by others, but it was used in this case to punish a child for her own mistake. In my view, the application of this criminal statute to the conduct at issue violates the child’s right to privacy under Article 1, Section 23 of the Florida Constitution.”
I agree that it is odd that how the police found out was left out, though the simplest explanation is usually the most correct, and not NSA involvement….
I say the parents had a filter of some sorts on the email. Or the girl forgot to erase them off the family digital camera.
this happened a little while ago when a girl was on xpeeps and her dad found it and she was charged with sexual abuse against her self and the distribution of child porn… or osmething liek that..
Some of the laws here are absurd for them able to be used in such a way that the person is both the defendant and plaintiff. The logic was probably “to teach her a lesson” (note the quotes), and “to scare out the bad guy.” This goes on the notion that people that young don’t know any better. But these days [younger] people do, and they have different ideas. Not to go on a rant, but the woman I was about to date, sees that even if you are almost in a relationship, you can freely mess around with other people.
