Personally, I think that this is a very valid clause in the law. Imagine that you’re browsing an image board… say, 4chan… where users can post anything that they like without (immediate) moderation. Someone post’s CP and it’s downloaded and stored in your cache as a large thumbnail. The next day the feds show up. Without this clause, you’d be bending over to pickup the soap for that first and last time without any recourse.

I’d hate to be prosecuted based on something that I may have accidently come across. I personally have little interest in visiting porn sites, but I have managed to get misdirected to them in the past.

Injecter, the cache directories files are replaced as newer files arrive. Sure, if someone wanted to preserve files in their cache directory from being removed, I’m sure they could, but that could easily be proven and be used against the person as proof of their intentions. Doing this would also show that the person knew possessing the pictures was wrong which I’m sure would not work in his favor.

Well this is a tricky loophole.. i mean in some instances.. if you were browsing and lets say a pop up window appeared dipicting somthing that wouldnt normally be part of your daily browsing habbits.. i could see where one could be accused of somthing they didnt willing commit.. however.. if this guy was looking at child porn.. and then played it off like he never meant to.. then thats sick.. unfortunately thats part of our legal system… what benefits the good, could be manipulated to work for the bad..
