Antenna repair results in $15,000 worth of damage

I brought it in for two small warranty items, a jammed trunk, and a bad antenna, on 12/19/06. and told them not to drive it off the lot, and the next morning, Gene B, an employee, took it on a ride and wrecked it, causing about $15,000 in damages to the front passenger side. [...] The dealer is refusing to replace the car or compensate me for the lost value on resale. It took two days to get a claim # and a rental. I found some drugs under the seat in an orange prescription bottle, codeine acetominaphane, and some other pills. [...] A lawyer will cost us $5,000. I have more pics but don’t know how to post them. The dealer says his driver was not cited for reckless driving, but the police never do that unless they witness it, and even then, it takes 100mph in a 25mph zone for them to cite. It might help us for people to let the dealer know they bad publicity will prevent them from buying from that dealer. It will take 6 weeks for the car to be repaired, and we will not be driving it even after it is repaired due to the filthy nature of the drugs and the accident. This has ruined the car for us.

    It’s amazing what some businesses can get away with. When my iBook was stolen out of a repair shop, they refused to comp me for the loss, because as they worded it, “we don’t have theft insurance.” Fortunately I had a supplemental insurance policy that had a $25 deductible.

    Still though, I would be fuming if someone caused $15,000 in damage to my car.

    If you can afford a vette, you can afford to pay for a lawyer. You can easily win a case against them if your car was not broken when you dropped it off and was when you picked it up. Plus you could easily have your legal fees reimbursed (include within damages, so a $20K + settlement) since this all could have been avoided if they rightfully repaired it in the first place. It baffles the mind when someone second guesses a lawsuit when there was really something wrong done, yet others will sue Nintendo for their own negligence. If he doesn’t sue, I don’t pity him. Bad things happen to people all the time, if it’s within your own power to make it right, but decide not to, any pain and suffering is your own fault.

    I would park it out front of the lot with a big sign on it that said “they wrecked, but they won’t fix it…. don’t buy your cars here”

    I’m sure that would be great for business…. realistically I find this a bit tough to believe … but if it is true, there is NO WAY this guy could lose a case in court.

    The employee IS the company! It might as well have been the dealership owner who wrecked your car. Get the lawyer. Also, the dealership should have had the employee tested for alcohol and drugs after the wreck.

    People’s Court is small claims, aka $5000 or less :P
