10 years in prison for consensual sex

More examples of the US legal system, a Georgia man fights his 10 year conviction for having consensual sex (at the age of 17) with a 15-yr. old girl ["an offense that constituted aggravated child molesting"].

Genarlow Wilson, 20, is serving a prison sentence that shocked his jury, elicited charges of racism from critics of the justice system and that even prosecutors and the State Legislature acknowledge is unjust.

He was sentenced to 10 years in prison without parole for having consensual oral sex with a 15-year-old girl at a New Year’s Eve party, an offense that constituted aggravated child molesting, even though Mr. Wilson himself was only 17.

With Mr. Wilson — a football player, honor student and the first homecoming king at Douglas County High School — nearing two years in prison, the Georgia Supreme Court declined last Friday to hear his appeal.

    A second girl, a 15-year-old, also attended the party, but did not drink or smoke. She had what she later said was consensual oral sex with Mr. Wilson. But according to the law, a 15-year-old is below the age of consent. Mr. Wilson went to trial on charges of rape and aggravated child molesting.

    How does that even begin to support the 10-yr. sentence? Not to mention the long term label of being a sex offender? 17-yr. old and 15-yr. old consenting to have sex..?

    If I’m not mistaken, and I never am, sex between a minor and someone of consenting age within three years of age of each other is only a misdemeanor, if it isn’t looked past at all.

    Personally, I think age of consent is a gift and a blessing. Sure, it keeps the “little kids” from being molested and what not, but it puts a lot of people in trouble for something that, not until the last 50 years, was in fact normal, and quite frankly, they would have the option to marry anyway.

    I did some research and it appears that Georgia doesn’t even have a standing “Sodomy Law” anymore. So there goes that out the window.

    “Got what he deserved” is a pretty ridiculous response (more so because you made no attempt to explain why oral sex between two teenagers is equivalent to child molestation and rape). It’s the kind of response that I would imagine is indicative of a larger (crack-head-like) mentality.

    I’m not sure about Georgia, but I know that in most states – including NY – there IS the three year rule where it’s not illegal to have consensual sex with someone under the legal age, yet 3 years or less apart from your age. e.g. 16 & 19. Also any state with the 18yr. designation would recognize both these people as minors, so there would be no crime either. I guess all that is arbitrary if Georgia has neither of these in place – but – give me a friggin’ break. How many 15 & 17 year old kids hook up at parties – this wasn’t even close to rape, molestation or any charge whatsoever, The poor man should be set free and given a formal apology for the 2 year’s he’s served. I too would be quick to push the ‘racism’ button on this one, because (sadly) this was in Georgia – and the outcome of the case if so ludacris that that is the only thing that could possibly seem to explain the sentence.

    Have you walked around a mall lately, I can tell you there have got to be about half the 15 year olds there that would give a BJ no problem. He made a bad decision, but damn 10 years for a BJ, that is BS. But I guess the real people that need to be brought to court are the ones who pursued criminal actions against the boy.

    Somehow I have the feeling you couldn’t read such a stupid story in Europe :( I mean… C’mon… 15-17 ! This is even more stupid than our Football referee getting JAILED for arranging some games… Why the hell does “normal” people have to be send to Jails, in the middle of criminal ??!

    What the hell? I thought that whatever happened on NYE would be forgotten the day after. Regardless, it is quite obvious that the outcome of the case is nonsense. It goes against any measure of common sense.

    Btw, who filed the accusation? Was it the girl?

    Hmm, I guess I should be glad that I don’t kiss and tell. Anyway, this case is blown way out of proportion. I can just imagine it now: “Seventeen year old Joe Blow fined $5000 for osculation with a girl below the age of consent.”

    It’s perfectly natural for teenagers to date/screw outside of their age groups, and this guy wasn’t even an adult at the time. I mean, if every senior who engaged in oral sex with a sophomore (on either end of the deal) were thrown in jail, we would lose almost an entire generation of guys.

    By the way, Jon, it’s “per se,” a Latin phrase meaning “through itself.”

    Hey its me, guess what I think.
    I agree on the fact that there is no magic bullet that hits you when your 18 that changes you form when you were 17, but that only allows slight flexibility, if we say 15 year olds giving blow jobs to 17 year olds, then whats to argue a 14 year old doing it, she could only be a week younger then the 15year old, or even a day, and then what if it was a 18 year olds birthday party, so therefor time wise it could be a 18 year old getting head form a 14 year old.
    And what happens if that 15 year old hasn’t had her period, but a 13 year old has, just because her body is more “mature” towards a sexual peek doesn’t make her a better candidate.
    The law is there to get rid of the fogginess, society had to pick a age, and most picked 16 and up with rules on how many years older the partner must be ect.
    And its laughable that they try to play it up, oh he was a football player, and honer student, so he reasons for getting head must of been honorable. lol

    To add another twist, what if he said no and she slobbed it anyway. Would that make her a weapon, using her body to inflict harm onto him?

    The reason why they listed his qualities as a person is to show that he had a future, until he was sentenced to 10 years as a juvenile. All of his achievements indicate he would have gone to college and made something out of himself.
    Sometimes I see why a lot of people think the “man” is trying to keep them down. He never robbed anyone, never shot anyone, never attacked anyone, and never raped anyone. He had a clean record. F*cked if you do, f*cked if you dont.

    Well, he certainly did get f*cked for getting f*cked. In any case, it’s an example of the law destroying a life that could have become more. The heavy-handedness of the government in this case doesn’t have a positive effect on anybody. The guy gets sent away for 11 years (10 w/o parole) and can never lead a normal life. The girl isn’t “protected” in any way. She decided to blow him, so the only one she really need protection from is herself. This guy wasn’t a criminal, just an ordinary teenager with ordinary teenage attractions and reactions that don’t just apply to girls seventeen years and older. If you read the article, it states that there were already exceptions to the law, and if he had gotten her pregnant, he would have been much more gently treated.

    Justice was not served.

    Well Dogcow, in fact he did rape her, even if it was “only” statutory.
    Id love you to approach a rape victim and say, well at least you enjoyed it with out being mentally prepared for that kind of situation. Or better yet, say, what kind of rape happened to you? The good one or the bad one?
    And if he said no its not inflicting harm, its just sexual assault.
    Just because hes a man doesn’t make him less of a person, its because of outlooks like that I am creating my documentary on equality.

    I’m not sure where your so called facts are coming from, or if you have some kind of mental filter that ignores them, but it clearly stated in the article that he did not rape anyone.

    After watching parts of the tape, the jury decided that Mr. Wilson had not raped the older girl. But it was bound by law to find him guilty of molesting the 15-year-old.”

    And in case you’re wondering, the wording “bound by law” indicates that they did not deliberate on if he was guilty of molesting. Let me reiterate that she said it “was consensual oral sex.” That is not rape.

    It’s probably why Derek called it “10 years in prison for consensual sex” rather than “10 years in prison for a guy maybe almost 18 years old possibly raping a girl who may have just turned 15 years old who has not had a period yet through oral sex.” haha.

    Saying that I approve of rape is a fallacy. I approve of justice and logic, both of which seem to escape me in this case.

    My roommate has a friend of his, who was in the middle of having sex with a girl when they were both 17, and it was approaching Midnight. but when they finished it was the next day, and he therefore had turned 18 in the middle of having sex.

    Well the girl, along with her family (who probably were the one that got her to do this) decided to bring the guy to court alleging that he was having sex with a minor, when in reality at the start of the intercourse they were both 17 and was entirely consensual.

    Now isn’t that stupid. Well it just happens that (this is all from the details my roommate told me, I don’t know the guy or every fact of the case) the girl’s family got a really good lawyer or something, or the guy didn’t defend himself well, but the jury went in favor of the girl, and now the guy is on parole.

    He is planning to attend my college in the next year or so, but is awaiting what is going to end up happening to him.

    Just because the statutes declare it as rape does not mean that it is just. That is what people are arguing here. This case is unjust. Teenagers will explore sexually, and a year or two of age is rarely a boundary. Nobody here is saying the guy was legally innocent. Calling the guy a rapist is rather inacurate, and he did not engage in intercourse with the 15 year old in any case. The conviction was of molestation, not rape.

    My girlfriend and I both of us loose our virginity when I was 18 and she was 14. We were together 10 more years (not that it matters anyway). And if someone dares to call it abuse, well, check your head man, because its the most natural thing in the world. USA is a very sick society full of hypocrisy where children are sent to kill other children in war and then they say they protect children, what a bunch of hypocrites :(

    Just read the Law about statutory rape and must say it’s the most ridicilous script since the old testament. The whole story of a 17 year old boy and a 15 year old girl having sex is normaly not even worth mentioning here in Europe and i’m sure in most of the USA as well so there seems to be more behind it than just that. Racism? Maybe. We could talk conspiracy here, another great ‘american’ topic (and i really mean that, i enjoyed Vineland immensely) but that doesn’t help at all. Making an uproar about this may. So: any ideas out there? Get musicians involved and start a project like ‘free the west memphis three’? All of us who believe that Justice wasn’t served by condemning a 17 year old boy to 10 years of prison should speak up and let ‘them’ know that we don’t appreciate that kind of judicial abuse.

    17 year old boys having sex with 15 year old girls is old as sex itself. This young man should be set free so he can move on with his life.He only did what any 17 year old would have done he got his dick sucked.
